Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Dream Noise mobile application and related services (the “Service”), provided by Dream Noise (“we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least the age of majority in your jurisdiction to enter into these Terms, or at least 13 with the consent and supervision of a parent or legal guardian. By using the Service you represent that you meet these requirements.

2. The Service

Dream Noise provides calming sleep sounds and AI-narrated bedtime stories. Some content is available for free; other content requires a subscription. We may add, change, or remove features and content at any time.

3. Accounts

You can use the Service as a guest or sign in with Apple or Google. You are responsible for activity that occurs under your account and for maintaining the security of your device and credentials. You may delete your account at any time from within the app.

4. Subscriptions, Free Trials, and Billing

The Service offers a paid subscription (the “Standard” plan) with an introductory free trial. Pricing is shown in the app at purchase and may vary by region.
Purchases are processed by the Apple App Store or Google Play, and are subject to their terms. Payment is charged to your store account at confirmation of purchase.
Auto-renewal. Subscriptions renew automatically at the then-current price unless canceled at least 24 hours before the end of the current period. A free trial, if offered, converts to a paid subscription unless canceled before it ends.
Managing and canceling. You manage and cancel your subscription through your Apple or Google account settings, not within Dream Noise directly.
Refunds are handled by Apple or Google in accordance with their policies.

5. License and Restrictions

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You agree not to copy, distribute, publicly perform, modify, reverse engineer, resell, or create derivative works from the Service or its content, except as permitted by law.

6. Intellectual Property

The Service and its content, including audio, stories, text, graphics, and trademarks, are owned by Dream Noise or its licensors and are protected by intellectual property laws. All rights not expressly granted are reserved.

7. Acceptable Use

You agree not to misuse the Service, including by attempting to access it through unauthorized means, interfering with its operation, circumventing access or subscription controls, or using it in violation of applicable law.

8. Wellness Disclaimer

Dream Noise is intended for relaxation and entertainment. It is not a medical device and does not provide medical, psychological, or therapeutic advice, diagnosis, or treatment. It is not a substitute for professional care. If you have concerns about your sleep or health, consult a qualified professional.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Dream Noise and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50.

11. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or to protect the Service. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination will survive.

12. Governing Law

These Terms are governed by the laws of [Governing-law jurisdiction], without regard to its conflict-of-laws rules. The courts located in that jurisdiction will have exclusive jurisdiction over disputes, except where prohibited by applicable law.

13. Changes to These Terms

We may update these Terms from time to time. We will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
